NSLDN Seeks Copies of Department of Education’s Use of its Subpoena Power

On December 6, 2018, NSLDN submitted a FOIA request to the United States Department of Education seeking all administrative subpoenas issued by the Secretary of Education, or the Secretary’s delegee, pursuant to her authority under the Higher Education Act (“HEA”). The HEA gives the Secretary both the power to issue subpoenas and the ability to enforce them. The Secretary’s use of this subpoena power is meant to assist with the Department’s investigations of possible Title IV violations.
